Overview
Your privacy is very important to us. This Privacy Policy informs you of our privacy practices with respect to the information Propel collects from users of Propel PBM Software and subscribers to the PBM Update Service (the PBM Software license grant and the PBM Update Service are collectively referred to herein as the “PBM Product"), how we use, share and protect such information, and the choices you have concerning the collection and use of such information. Propel encourages you to read this Privacy Policy carefully.
As used in this Privacy Policy, the term “personally-identifiable information” means information that can identify you as an individual, such as your name, address, email address, or phone number, and that is not otherwise publicly available. Propel is committed to protecting personally-identifiable information that we collect in connection with your use of the PBM Product. We use such information in accordance with this Privacy Policy.
What Information Does Propel Collect?
Subscriber Information
Users are asked to provide certain information when they sign up for the PBM Product such as name, physical address, telephone number, email address and billing information (such as a credit card number). The personally-identifiable information collected from Users during the registration process is used to manage each User’s account (such as billing and collections). Your credit card or other form of payment information may be processed by, or disclosed to, third parties in order to process or otherwise complete the transaction for which payment is made.
Network Traffic Type and Volume Information
PBM Software reports its network traffic type and volume to the Propel network or servers periodically. You may request that Propel not collect this data and opt-out of this report to Propel by selecting the “About Propel PBM” command in the Propel PBM menu, clicking "Advanced..." and unchecking the "Allow statistical reporting of summary networking data" box.
Communication Information
If you communicate directly with Propel by email or letter in connection with the PBM Product, Propel may collect and store a record of your communication. Such communication information may, without limitation, include information you provide to Propel as part of PBM Product support inquiries such as your contact information and information about your computer hardware, software and the nature of the problem you are experiencing. Personally-identifiable information that is not collected in connection with the PBM Product is not generally subject to this Privacy Policy.
PBM Product Information; Computer Information
PBM Software uses Internet protocols which send to a Propel or Propel-managed server information related to the PBM Product and computer information, such as your Internet protocol address and the type of your browser and operating system.
How Does Propel Use the Information and With Whom Do we Share the Information?
Propel does not share, rent, lease or sell your personally-identifiable information to third parties for their marketing purposes without your consent. We use your personally-identifiable information only as described in this Privacy Policy and do not disclose your personally-identifiable information to others in ways different from what is disclosed in this Privacy Policy. We use and/or disclose your personally-identifiable information to process and fulfill your requests and inquiries, validate you as a registered customer, confirm PBM Software activations, assist problem resolution and tracking, assist in the diagnosis, maintenance, support, development and improvement of our products and services and the protection, management and development of our business and operations, comply with mandatory legal and regulatory requirements, and to inform you about matters affecting the PBM Product, this Privacy Policy, your account and the PBM Product Terms of Service/Software License Agreement. We may use, disclose, share or otherwise exploit non-personally-identifiable information (for example, without limitation, to perform statistical analyses of users' aggregate behavior so that we may enhance the content of our products and services). You may receive promotional communications from Propel; however, you may opt out of receiving future promotional communications from Propel by following the "unsubscribe." directions in each promotional message.
Propel; Agents
Propel may utilize trusted third party companies and individuals to perform functions on our behalf, including, without limitation, companies with whom we may have administrative relationships, such as a third party eCommerce site at the point of purchase which may collect personally-identifiable information (including credit card information) when you make a purchase, and share some of that information with Propel. Such third parties may have access to information needed to perform their functions that are specifically related to the PBM Product and to Propel's permitted uses. Such third parties may have different privacy practices and we encourage you to read their privacy policies.
Business Transfers
Propel may become subject to a corporate merger, acquisition, reorganization or similar transaction involving the sale or combination of a material part or substantially all of its PBM Product-related assets. In such circumstance, Propel reserves the right to disclose personally-identifiable information to a prospective acquirer or merger candidate, and/or transfer personally-identifiable information to a merged or resultant business entity, without obtaining your further consent. In the event of such a transaction, if there is a material change in the way your personally-identifiable information is handled, as a result of a different privacy policy of such merged or resultant business entity, we will send you email notification about such changes to the email address you provided at the time of purchase.
Protection of Propel and Others; Compliance with the Law: Children’s Privacy
Propel reserves the right to effect access, use, preservation or disclosure of personally-identifiable information, in the good-faith belief that such action is reasonably necessary to (a) comply with applicable law, regulation, legal process (such as a court order, search warrant or subpoena), a governmental request; (b) establish or exercise its legal rights, defend against legal claims or respond to any claims against it, or (c) protect the rights and property of Propel or the personal safety of any person; (d) enforce compliance with this Privacy Policy or the PBM Software Terms of Service/Software License Agreement, including the investigation of potential violations thereof, or (e) detect, investigate, prevent or otherwise address illegal activities, suspected fraud, security or technical issues, or as otherwise required or permitted by law. This includes, without limitation, exchanging information with other companies and organizations for fraud protection. It is our policy to comply with the Children’s Online Privacy Protection Act of 1998 and other applicable laws. You must be 18 years of age or older to use the PBM Product. Propel does not knowingly collect personally-identifiable identifying information from anyone under the age of 18.
How Does Propel Protect Personally-Identifiable Information?
Propel implements organizational, physical and technical safeguards and security systems designed to protect the personally-identifiable information it collects, maintain data accuracy and enable the correct use of such information. While Propel has implemented safeguards to help prevent unauthorized access to or misuse of your personally-identifiable information, we do not guarantee that such information will never be accessed, altered, destroyed, disclosed or used in a manner inconsistent with this Privacy Policy (for example, resulting from unauthorized access, data loss, hacking, breaches or other acts or omissions by third parties that are unlawful or violate this Privacy Policy).
Terms of Use/Software License Agreement; International Users; Privacy Policy Updates; Contacting Us
This Privacy Policy should be read in conjunction with the applicable Terms of Use/Software License Agreement (“TOS/SLA”) governing the PBM Product. By providing or otherwise making available personally-identifiable information for collection as described herein, all users of the PBM Product, including, without limitation, users in the member states of the European Union, fully understand and unambiguously consent to this Privacy Policy, and to any transfer of their personally-identifiable information to, and the collection, storage, accessing and processing of such information in the United States of America, and other countries which do not or may not offer an equivalent level of protection to that required in the European Union, for the uses specified in this Privacy Policy.
Propel reserves the right to change this Privacy Policy from time to time. We will post an updated Privacy Policy on this website. Use of personally-identifiable information that Propel collects is subject to the Privacy Policy in effect at the time of use. If under an updated Privacy Policy, we materially change the way we handle your personally-identifiable information, we will send you email notification about such changes in the updated Privacy Policy to the email address you provided at the time of purchase.
